VWP-Reisenden, die keine ESTA-Reisegenehmigung vorweisen können, nachdem das ESTA-System verbindlich geworden ist, kann der Zutritt zu Flugzeug oder Schiff verwehrt werden; sie müssen mit längeren Wartezeiten rechnen und die Einreise in den Vereinigten Staaten kann ihnen verwehrt werden.
Die Regelung betrifft ins Ausland reisende US-Staatsbürger nicht.

ESTA is an application system for all travelers from Visa Waiver Countries. The Visa Waiver Program has made visiting the United States very easy for millions of visitors with a machine readable passport. Now, due to heightened security regulations, the same visitors must apply for a Travel Authorization in advance. As always, a passport from a Visa Waiver country is still required to gain admittance to the country. The entire application process is conducted online and operated by the U.S. Department of Homeland Security (DHS).
The Travel Authorization is not a visa. In fact, a person from a non-visa waiver country should not even attempt to apply for a Travel Authorization. The purpose of ESTA is to allow DHS to pre-screen all Visa Waiver Travelers before they leave their respective countries. US bound travelers are recommended to apply for the Travel Authorization at least 72 hours prior to departure. An approved Travel Authorization is not a guaranteed entry, but a prerequisite to travel to the United States by air or sea carrier.

When should you apply for a Travel Authorization?
- Any traveler that intends to visit the United States under the Visa Waiver Program via air or sea
- Any traveler transiting through the United States under the Visa Waiver Program
- Children and infants who visit or transit to the Untied States under the Visa Waiver Program
- Citizens from all of the Visa Waiver countries must apply and be approved after January 12, 2009
- Travelers transiting through the United States must also possess an approved Travel Authorization
- If your application for a Travel Authorization is denied, you must apply for a B-1 Visitor Visa or B-2 Tourist Visa which can take weeks or months
Q: If people have received ESTA approval, do they also need to fill out an I-94W?
A: DHS has been coordinating with commercial air and vessel carriers on the development and implementation of messaging capabilities for passenger data transmissions that will enable DHS to provide the carriers with messages pertaining to a passenger's boarding status. A prospective VWP traveler’s ESTA status is a component of a passenger’s boarding status that has been introduced into the plans for implementing messaging capabilities between DHS and the carriers. The implementation of the ESTA program will allow DHS to eventually eliminate the requirement that VWP travelers complete an I-94W prior to being admitted to the United States.
After Jan. 12, 2009, a VWP traveler with a valid ESTA will not be required to complete the paper Form I-94W when arriving on a carrier that is capable of receiving and validating messages pertaining to the traveler’s ESTA status as part of the traveler’s boarding status. Until ESTA is mandatory, however, all VWP travelers applying for admission at a U.S. port of entry, including those VWP travelers who possess a voluntary ESTA authorization, must still present the Form I-94W to U.S. Customs and Border Protection.
