Hier wieder eine How-To, diesmal fuer I-751 Removal of Conditions packet assembly, paperwork, procedure.
I-751 Petition to Remove Conditions on Residence (kurz, Removal of Conditions) ist die Prozedur, die man durchgehen muss um eine 2-jahres Green Card in eine permanent (10-jahres) Green Card umzuwandeln.
Anmerkung: "Permanent" ist nicht gleich permanent. Eine permanente GC muss alle 10 Jahre erneuert werden, dafuer braucht man allerdings keine Petition, es dauert aber und es kostet auch. Allerdings ist eine Green Card keine get-out-of-jail-free card. Etwas anders wie citizenship, die kann unter umstaenden einfacher revoked werden. Es ist ein Privilleg und kein Recht.
FYI: Wenn man sich gegen US citizenship entscheidet und "nur" seine Green Card behaelt und sich damit legal in die USA aufhaellt muss man immer im Kopf behalten (diese koennen zu Green Card revocation fuehren):

Wann file-n?
Das wichtigste an der I-751 Petition ist das Timing. Das Removal of Conditions Zeitfenster geht auf 90 Tage vor Ablauf der Conditional GC / 90 Tage vor dem zweiten Jahrestag der Antivierungsreise und geht zu wenn die Conditional Green Card auslaeuft. Seit dem Zeitpunkt, ohne neue GC und ohne extension, ist man in USA illegal und ist subject to removal. Alle I-751 petitions die USCIS kriegt sogar ein Tag VOR oder NACH dem Zeitfenster werden automatisch denied.
USCIS garantiert nicht das Verschicken von reminders, also bitte selber sehr genau drauf achten!! Frueh (aber innerhalb Zeitfenster) I-751 beantragen ist extrem wichtig! Am besten schon vor man I-751 eligible wird das Packet zusammenstellen und sofort wenn das Zeitfenster aufgeht verschicken damit man Zeit hat auf Anfragen seitens USCIS, RFEs etc zu reagieren.

Fuer jeden dependent + $80
Am besten mit personal check bezahlen (unbedingt von joint account falls vorhanden) damit man genau sieht wann USCIS das fee ausgezahlt hat. So hat man eine Idee ob und wann sich was tut.

Fuer military und DoD civilians und deren dependents, die im Ausland auf official Government/Military Orders sind, gelten spezielle Umstaende.
Spouses koennen, vor man PCS-t expedited I-751 beantragen oder wenn der PCS move fuer laenger als ein Jahr ist sogar expedited naturalization, auch vor sie die residency requirements erfuellt haben.

In Deutschland ist das Generalkonsulat Frankfurt das fuer I-751 und andere immigration issues zustaendige USCIS liaison, aber man muss immer noch in USA file-n.
Hier gelten auch Regel fuer anderes required evidence (statt Kopie der GC):
Auszug von Instructions: Those who reside overseas pursuant to military or government orders, including conditional resident dependents residing overseas and listed under Part 5 of the form, must submit the following items with Form I-751:
1. Two passport-style photos for applicants and dependents, regardless of age.

I-751 joint oder allein?
Nomalerweise file-t man zusammen, wenn mann noch verheiratet ist. Falls die Ehe nicht mehr existiert, wegen Scheidung, Annulierung etc., kann man auch allein Removal of Conditions beantragen, man muss aber beweisen, dass diese Ehe in "good faith" eingegangen wurde und dazu braucht man starke Beweise. Hardship muss auch nachgewiesen sein.
Diese Ausnahmefaelle sind in den I-751 Instructions erklaert:
If you were granted conditional resident status through marriage to a U.S. citizen or permanent resident, use this form to petition for the removal of those conditions. If you are still married, the petition should be filed jointly by you and the spouse through whom you obtained conditional status.
However, you may apply for a waiver of this joint filing requirement if:
1. You entered the marriage in good faith, but your spouse subsequently died;
2. You entered the marriage in good faith, but the marriage was later terminated due to divorce or annulment;
3. You entered the marriage in good faith and have remained married, but have been battered or subjected to extreme cruelty by your U.S. citizen or permanent resident spouse; or
4. The termination of your status and removal would result in extreme hardship.

Das ist das wichtigste im Packet. Wenn man gute Beweise hat, kann man ein Interview umgehen und direkt approved werden. USCIS hat das Recht Interview Requirement Waivers zu vergeben wenn sie keine "doubts about the case" haben und die mitgeschickten Beweise deren genuegen.
Evidence of Relationship ist so gut wie alles worauf beide Namen drauf stehen.

Die unteren Schritte sind optional. USCIS Files sind top hole punched und man kann denen ein wenig entgegen kommen, wenn man schon alles so gemacht hat wie sie's brauchen damit sie's nur von eurem Folder in den USCIS Folder tun koennen.
Einen manilla Folder holen und den auf der oberen horizontalen Kante durchlochen und ein ACCO Klammer durchbringen
Genau so alle Unterlagen ausser Cover Letter durchlochen. Unterlagen in der Reihe aufgelistet im Cover Letter einordnen. Auf der unteren Kante, am besten Tabs mit dem Nummer entsprechend dem Cover Letter beschriften.
Check reintun, Cover Letter auf der forderen Seite vom Folder mit paper clip befaestigen. Alles durchgehen. Rein in den Umschlag. Fertig.
Kleiner Tipp: Eine exakte Kopie vom Packet vorbereiten. Wenn man zum Interview muss, dies mitnehmen, zusammen mit den Originalunterlagen. Sicher stellen, dass beide Ehepartner deren Drivers Licenses mit dabei haben, beide deren Hausschluessel mit dabei haben und natuerlich Eheringe tragen

- Change of Address muss immer innerhalb 10 Tagen von Umzug mittels AR-11 gemeldet werden (ansonsten ist das eine felony). Wenn man ein Sponsor hat und er noch dem Affidavit of Support gebunden ist, muss der auch seine Adressaenderungen melden mittels I-865.
- Niemals sagen oder schreiben, dass man citizen ist.
- Niemals versuchen in Federal Elections zu waehlen.
- Immer 6 Monate vor expiration date Permanent Resident Card erneuern.
- Man darf sich nicht laenger wie 364 Tage am Stueck ausserhalb USA aufhalten, 2 Jahre mit gueltigem Re-Entry Permit. Ansonsten gilt die residency als abandoned.
- Taxes muessen jedes Jahr ge-file-t werden, ohne Ausnahmen. Ausserdem muss man drauf aufpassen, dass man niemals ein Non-Resident tax return (1040NR) file-t. Ansonsten gilt die residency als abandoned.
- Alle US-Gesaetze beachten und nicht kriminael auffaellig werden - felonies, terrorist activities, violent crimes, crimes of "moral turpitude", drug-related offenses, lie to receive benefits (immigration and public), failure to register for Selective Service, failure to pay child support, DUIs etc. sind alles Dinge woran man die GC von jetzt auf gleich verlieren konnte

- Joint loans
- Joint federal und state tax returns
- Titles fuer Autos die Beide Namen drauf haben, insurance cards etc.
- Utility bills mit beiden Namen drauf - laesst sich sehr leicht machen, provider anrufen und drum bitten, besonders gut wenn man nicht viele und / oder staerkere Beweise hat
- Insurance plans - life, health etc. die den anderen als beneficiary nennen
- Military orders fuer die Familie
- Bilder - zusammen, mit Familie, Bilder von den Kindern, pets etc. Mit Datum und Ort
- Boarding passes von Fluege die man zusammen gemacht hat fuer Urlaub etc.
- Auch ein muss wenn man keine viele Beweise hat und ansonsten auch (minimum zwei) Sworn (also notariel beglaubigt) Affidavits von US citizens. Diese Affidavits sind nicht unbedingt noetig (also nicht mandatory), aber erwuenscht: Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship. (Such persons may be required to testify before an immigration officer as to the information contained in the affidavit.) The original affidavit must be submitted and also contain the following information regarding the person making the affidavit: his or her full name and address; date and place of birth; relationship to you or your spouse, if any; and full information and complete details explaining how the person acquired his or her knowledge. Es gibt kein Template fuer die Affidavits, man erklaert kurz und knapp wer man ist, ob man Familienmitglied (Mutter, Vater, Bruder, Grossmutter, Onkel etc), Freund, Kollege, Bekannte etc ist, z.B. wie und wann den Immigrant kennengelernt haben, z.B. wann man sich sieht (Oma sagt sie kommen zu mir fuer Weihnachten und Ostern, alle zwei Wochenenden einmal etc.) und wie man sie als Familie so sieht...

Genau so alle Unterlagen ausser Cover Letter durchlochen. Unterlagen in der Reihe aufgelistet im Cover Letter einordnen. Auf der unteren Kante, am besten Tabs mit dem Nummer entsprechend dem Cover Letter beschriften.
Check reintun, Cover Letter auf der forderen Seite vom Folder mit paper clip befaestigen. Alles durchgehen. Rein in den Umschlag. Fertig.
Kleiner Tipp: Eine exakte Kopie vom Packet vorbereiten. Wenn man zum Interview muss, dies mitnehmen, zusammen mit den Originalunterlagen. Sicher stellen, dass beide Ehepartner deren Drivers Licenses mit dabei haben, beide deren Hausschluessel mit dabei haben und natuerlich Eheringe tragen
